2026 Status Update: SSI Overpayment Relief & Campos Settlement

If you received an SSI overpayment notice between March 2020 and April 2023, you are part of the Campos v. Kijakazi class action. Here is the current status as of March 2026:

  • Automatic Waivers: Most “Group 1” waivers (for overpayments between March–Sept 2020) were processed in late 2025. Check your my Social Security account to confirm.
  • Missed Your Notice? The SSA finished mailing settlement notices in June 2025. If you missed yours, you can still request a waiver manually under the new “COVID-19 Circumstances” guidelines.
  • The $2,000 Rule: New for 2026, the SSA has expanded “Administrative Waivers” for debts under $2,000, making it easier to resolve minor overpayments over the phone.

The Campos v. Kijakazi settlement was a landmark victory for the 2.5 million SSI recipients whose benefits were disrupted by SSA office closures during the pandemic. However, as we move through 2026, many seniors are still navigating the “recovery” phase of this settlement.

Recap: What the Campos Settlement Fixed

The settlement addressed the fact that many beneficiaries couldn’t report income changes because SSA offices were closed. This led to “technical overpayments” that weren’t the fault of the recipient.

  • The 250k Automatic Waiver: Approximately 250,000 people had their debts wiped clean automatically because the error occurred during the peak of the 2020 lockdowns.
  • The 2 Million Waiver Opportunity: For overpayments occurring between October 2020 and April 2023, the SSA agreed to a more “lenient” review process that considers pandemic-related hardships.

What to Do in 2026 if You Still Have an Overpayment

If the SSA is still garnishing your check for a pandemic-era debt, you must take action. The “automatic” window has largely closed, but your legal rights remain.

1. Request a Waiver (Form SSA-632)

Even if you didn’t get an automatic waiver, you can file Form SSA-632 at any time. In 2026, the SSA is instructed to look for “COVID-19 Circumstances.” If you couldn’t reach the office or mail documents due to the pandemic, mention this specifically on your form.

2. Use the “30-Day Shield”

If you receive a new overpayment notice in 2026, file your appeal or waiver request within 30 days. This legally “pauses” the collection process, meaning the SSA cannot take money from your check while they review your case.

Can the SSA take 100% of my check for an overpayment?
No. As of 2026, the default withholding rate for SSI overpayments is typically capped at 10% or $10, whichever is greater, unless fraud is suspected.
What if my overpayment is from 2024 or 2025?
The Campos settlement only covers up to April 2023. For newer overpayments, you must use standard waiver procedures, though the new $2,000 simplified waiver rules may apply.
